Terms & Disclaimer
Last updated: August 2026
These Terms & Disclaimer ("Terms") govern your access to and use of airplanefly.com and related content published by Airplane Fly Advisory Pty Ltd (ABN 84 621 903 447) ("Airplane Fly", "we", "us" or "our"). By accessing or using this website, you agree to be bound by these Terms. If you do not agree, you must not use the website.
1. About Airplane Fly
Airplane Fly is an independent Australian aviation advisory and editorial practice based in Sydney, with editorial and route research operations in Brisbane. We provide structured research, editorial coverage and documented review processes relating to private and regional aviation in Australia.
We are not an aircraft broker, dealer, charter operator, financial services licensee, tax agent, legal practice or insurance intermediary unless explicitly stated in a separate written agreement.
2. General information only — not advice
All content on airplanefly.com — including editorial articles, route notes, aircraft profiles, service descriptions, statistics and downloadable materials — is provided for general information purposes only.
Nothing on this website constitutes:
- Legal advice or a substitute for consultation with a qualified Australian solicitor;
- Tax, financial product or investment advice regulated under the Corporations Act 2001 (Cth);
- Aviation operational, engineering or maintenance advice;
- A recommendation to acquire, dispose of or operate any particular aircraft;
- A representation regarding CASA regulatory compliance for any specific operation or airframe.
You must obtain independent advice from appropriately qualified professionals before making any aviation, financial, legal or regulatory decision.
3. No guaranteed outcomes
To the fullest extent permitted by law, Airplane Fly makes no representations, warranties or guarantees regarding:
- Aircraft availability, condition, title or market value;
- Investment return, capital appreciation or charter income;
- Tax outcomes, depreciation benefits or GST treatment;
- Financing approval, insurance placement or premium levels;
- Regulatory approvals, CASA certificates or operating permits;
- Route feasibility under actual weather, payload or crew conditions;
- Operational performance, utilisation rates or cost projections.
Any figures, ranges, examples or case references on this website are illustrative only unless explicitly confirmed in a signed advisory scope note addressed to you.
4. Advisory engagements
Formal advisory work is governed by a separate written scope note or engagement letter that defines deliverables, fees, timelines, exclusions, confidentiality terms and limitation of liability provisions.
Submitting a private brief or contacting us through the website does not create an advisory relationship, duty of care beyond these Terms, or obligation for us to accept an engagement. We reserve the right to decline enquiries at our discretion.
Where an advisory engagement is accepted, the terms of the signed scope note prevail over any conflicting website content.
5. Editorial content
Journal articles, route archive entries and aircraft profile notes represent the views of named contributors at the time of publication. They are intended for educational and contextual purposes.
Editorial content may not reflect current market conditions, regulatory amendments, manufacturer bulletins or insurance market practices. We publish corrections when material errors are identified, but we do not undertake to update historical articles proactively.
Contributors may disclose advisory relationships in article footnotes where relevant. Editorial independence is maintained from commercial acquisition interests — we do not accept commissions from aircraft sellers.
6. Acceptable use
When using airplanefly.com, you agree not to:
- Use the website for any unlawful purpose or in violation of applicable Australian or international law;
- Attempt to gain unauthorised access to our systems, servers or data;
- Introduce viruses, malicious code or automated scraping tools that impose unreasonable load;
- Reproduce, scrape or commercially exploit content without our prior written consent;
- Misrepresent your identity or affiliation when submitting enquiries;
- Submit false, misleading or defamatory information through contact forms.
We may suspend or restrict access to the website where we reasonably believe these Terms have been breached.
7. Third-party links and referrals
Our website may contain links to third-party websites, including regulators, manufacturers, aerodrome operators and professional service providers. These links are provided for convenience only. We do not control, endorse or assume responsibility for third-party content, availability or privacy practices.
Where we introduce you to an independent professional (engineer, solicitor, insurer or management company) at your request, that introduction does not constitute a partnership, joint venture or guarantee of their services. Your relationship with any referred party is directly between you and them.
8. Intellectual property
All content on airplanefly.com — including text, graphics, logos, layout, editorial archives, route documentation templates and underlying code — is owned by Airplane Fly Advisory Pty Ltd or licensed to us, and is protected by Australian copyright and intellectual property law.
You may view and print pages for personal, non-commercial reference. You may not:
- Reproduce, republish or distribute content for commercial purposes;
- Modify, adapt or create derivative works without written permission;
- Remove copyright notices or attribution;
- Use our branding, name or editorial materials in a manner that suggests endorsement without consent.
Requests for licensing or republication: [email protected].
9. Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) or other applicable legislation that cannot lawfully be excluded.
Where we supply paid advisory services, certain consumer guarantees may apply. Any liability for breach of a non-excludable guarantee is limited, to the extent permitted by law, to the re-supply of services or payment of the cost of re-supply.
10. Limitation of liability
To the maximum extent permitted by Australian law, Airplane Fly and its directors, officers, employees and contractors exclude all liability for any loss or damage (including indirect, consequential, special or economic loss) arising from or in connection with:
- Your use of, or reliance on, website content;
- Any interruption, error, omission or inaccuracy on the website;
- Any unauthorised access to or alteration of your transmissions or data;
- Any decision made or action taken based on information published on airplanefly.com.
Where liability cannot be excluded, our total aggregate liability arising from website use is limited to AUD $100 or the amount you paid us for related services in the preceding 12 months, whichever is greater.
Liability for formal advisory services is governed exclusively by the relevant signed scope note.
11. Indemnity
You agree to indemnify and hold harmless Airplane Fly from any claim, loss, liability, damage or expense (including reasonable legal fees) arising from your breach of these Terms, misuse of the website, or violation of any third-party rights.
12. Privacy
Your use of the website is also governed by our Privacy Policy and Cookie Policy, which explain how we collect and handle personal information.
13. Changes to these Terms
We may revise these Terms at any time by publishing an updated version on this page. The "Last updated" date will be amended accordingly. Your continued use of the website after changes are posted constitutes acceptance of the revised Terms. Material changes may additionally be noted on the homepage or via email to active advisory clients where appropriate.
14. Termination
We may terminate or restrict your access to the website at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us or third parties.
15. Governing law and jurisdiction
These Terms are governed by the laws of New South Wales, Australia. You submit to the exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia for any dispute arising from or relating to these Terms or your use of the website.
16. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue in full force and effect.
